Terms and Conditions

1. General

1.1  Please read these terms of service carefully before taking part in any games of chance on the Website. By registering an account with the Casino, you confirm that you have read, understood and agreed to these Terms and Conditions.

1.2  The Casino operates in accordance with the gambling regulations and obligations imposed by its applicable licence. The Casino may amend these Terms and Conditions and the VIP Terms and Conditions at its discretion. Players will be given notice of any material change within a reasonable period. Where a change requires player consent and a player does not provide it, that player is entitled to receive the outstanding balance of their account. This provision takes precedence over the Payments Policy and the Refund Policy at all times, unless stated otherwise.

1.3  The current English-language version of these Terms and Conditions prevails over any other edition or translation. In the event of any dispute, the current English version governs.

1.4  If any provision of these Terms and Conditions is held to be void or unenforceable by a court of law, the remaining provisions continue in full force and effect.

1.5  The Website is operated by Dama N.V., a company registered in Curacao (company registration number 152125), under e-gaming licence No. 8048/JAZ2020-13 issued by Antillephone N.V., authorised by the Government of Curacao.

2. Responsibility of the Parties

2.1  The parties to these Terms and Conditions are defined as follows: “Casino” (“Company”, “Us”, “We”, “Our”, “Website”) means the provider of the facilities you use for entertainment; “You” (“Your”, “Player”) means the end user who takes part in the Casino’s games of chance.

2.2  By accepting these Terms and Conditions, you acknowledge that taking part in games of chance can result in financial loss. The Casino accepts no liability for any loss or damage arising from your use of its services.

2.3  The Casino is not responsible for any hardware or software failure, unstable or interrupted internet connection, or any other technical fault that may restrict access to the Website or interrupt play.

2.4  If a wager or bet is confirmed in error, or a payment is made in error, the Casino reserves the right to:

  • cancel any affected wagers or bets and restore the account to its previous state in full; or
  • correct the error by re-settling the affected wagers or bets on the terms that should have applied at the time, had the error not occurred

2.5  If the Casino credits your account in error — with a payment, bonus, bonus funds or winnings that are not yours, whether because of a technical fault, a paytable error, human error or any other reason — that amount and any winnings derived from it remain the property of the Casino and will be voided.

2.6  If funds that do not belong to you are withdrawn before the Casino becomes aware of the error, the amount wrongly paid constitutes a debt you owe to the Casino, without prejudice to any other remedy available at law. You must notify the Casino by email of any incorrect crediting within 24 hours of the event.

2.7  The Casino, together with its management, employees, partners and service providers:

  • does not warrant that the software or the Website is fit for its purpose;
  • does not warrant that the software and the Website are free from errors;
  • does not warrant that the Website or the games will be accessible without interruption; and
  • accepts no liability for any loss, cost, expense or damage — whether direct, indirect, special, consequential, incidental or otherwise — arising from your use of the Website or your participation in the games

2.8  By accepting these Terms and Conditions, you agree to fully indemnify and hold harmless the Casino, its management, employees, partners and service providers against any cost, expense, loss, damage, claim or liability, however caused, that may arise from your use of the Website or participation in the games.

2.9  You acknowledge that the Casino is the final decision-maker as to whether you have breached these Terms and Conditions, and that it may take restrictive action including, without limitation, suspension, exclusion from any Casino communication channel, or a permanent ban from the games of chance on the Website.

3. Restricted Countries Policy

3.1  The Casino accepts players only from countries and regions where online gambling is permitted by law. By accepting these Terms and Conditions, you confirm that you are solely responsible for taking part in the games offered on the Website and that you are not breaching any law applicable to you in your local jurisdiction. Depositing and playing for real money is subject to the laws of your country, and it is your sole responsibility to comply with your local regulations.

3.3  The Casino may verify your identity through the KYC (Know Your Customer) procedure. 4. Games Availability and Rules

4.1  By accepting these Terms and Conditions, you confirm that you understand the rules of the games offered on the Website. It is your responsibility to familiarise yourself with the theoretical return-to-player (payout) percentage of each game. 5. Fees and Taxes

5.1  You are solely responsible for paying any fees and taxes due on your winnings under the laws of your country of residence.

6. Use of the Player’s Account

6.1  By registering and continuing to use the Casino’s services, you confirm that you are of legal age (18 or older) as required by applicable laws and regulations. You must not give any third party, including minors, access to your Casino account.

6.2  You may create and hold only one (1) account at any time. Creating, holding or using more than one account (a “Duplicate”) will result in the cancellation of all payments to you and the termination of the account(s) in breach of this rule. Any bonuses or winnings received or accrued through a Duplicate account will be reclaimed in full by the Casino.

7. KYC Procedure

7.1  Know Your Customer (KYC) is a mandatory verification procedure that confirms that the account holder is a real person, that deposited funds are of legitimate origin and belong to the account holder, and that funds released by the Casino will reach the correct payment account and person.

7.2  The documentation typically required to complete verification is set out below. The Casino may request additional documents at its sole discretion:

  • Proof of payment — a document confirming the payment you made to the Casino, generally showing the amount debited, the name of the payment account holder, and the payment date (procedures may vary by payment method)

7.3  Once the KYC procedure is complete, you will be notified by email, and you may also check the status with customer support. Completing KYC does not prevent the Casino from requesting further information later, such as new proof of identity if the previous document has expired, or new proof of address if your residence changes.

7.4  If you do not provide the required KYC documentation, you will be unable to receive payments from the Casino, and you will be informed of this by email. The Casino will make reasonable attempts to contact you using the details on your account. A lack of response, or continued refusal to complete the requested procedures, may lead to suspension and ultimately closure of the account. Any outstanding balance at the time of suspension or closure will be paid once you complete the requested procedures.

7.5  Funds shown to have been obtained by illegitimate means, or during any breach of these Terms and Conditions, will be retained by the Casino.

7.6  The Casino may require a video call with you, which, at its discretion, can form a necessary part of the KYC procedure; the account and any account activity may be suspended until verification is complete. The Casino will make reasonable efforts to contact you about a withdrawal, but if it cannot reach you within two (2) weeks of the date of your withdrawal request, the account will be locked, as the KYC procedure will not have been completed.

8. Payments Policy

8.2  The use of third-party payment systems is expressly prohibited. The Casino is not responsible for funds lost through deposits from, or withdrawals to, third-party payment accounts. If a security check shows that you have breached this rule, the Casino reserves the right to void any resulting winnings.

8.3  The Website supports the following currencies: EUR, USD, CAD, AUD, NOK, NZD, BTC, BCH, ETH, LTC, DOGE and USDT.

8.6  The minimum withdrawal is EUR 25, or the equivalent in your account currency (including AUD), and depends on the payment method you choose, as does the maximum amount. If a requested amount exceeds the limits of a particular payment method, it will be paid in instalments.

8.7  Each deposit must be wagered once (1x) — that is, you must place bets equal to the deposit amount — before funds connected to that deposit can be withdrawn. Where several deposits are made without any gameplay, the total of those deposits must be wagered before withdrawal. Otherwise, the Casino has the right to charge a fee to process the deposit and withdrawal, at its sole discretion.

8.8  The Casino applies maximum withdrawal limits of:

8.9  These limits apply at all times unless the terms of a specific promotion state otherwise. Withdrawal limits may also be varied for players with a higher VIP level at the Casino’s sole discretion, of which those players will be informed beforehand.

8.10  If your account holds a withdrawable winning balance above EUR 15,000 / USD 15,000 / CAD 20,000 / AUD 20,000 / NZD 20,000 / NOK 175,000, the Casino reserves the right to pay it in monthly instalments of up to that amount until the full sum has been paid.

8.11  The Casino reserves the right to verify your identity before processing payouts and to hold any refund or withdrawal for the time needed to do so. If you provide false or incomplete personal data, the withdrawal may be refused and the account terminated, and you will be notified by email.

8.12  All progressive jackpot winnings are paid in full.

8.13  The Casino is not a financial institution and must not be treated as one. Your account does not earn interest, and no currency conversion or exchange services are provided at any time.

9. Fraud Prevention

9.1  The Casino operates a strict anti-fraud policy and uses a range of tools to detect and prevent fraudulent activity that could undermine the integrity and fairness of its games.

9.2  You may be investigated where you are suspected of, among other things:

  • colluding with other players — two or more players cooperating to cheat or gain an unfair advantage, for example by sharing information or coordinating bets;
  • developing strategies intended to secure an unfair advantage or winnings by manipulating game outcomes for illicit profit;
  • carrying out fraud against other casinos, within the Casino’s network, or against payment providers;
  • initiating chargebacks or disputing transactions you have made;
  • creating more than one account in order to assume another person’s identity, for any purpose;
  • engaging in low-risk gameplay — for example systematically covering red/black outcomes on roulette, or covering 70% or more of the table (more than 25 of 36 numbers) to disguise the origin of funds or to transfer funds between players within the Casino; or
  • any other fraudulent activity addressed by current anti-fraud, anti-money-laundering and counter-terrorist-financing practice

9.3  The Casino has zero tolerance for advantage play. Any player who attempts to take advantage of Casino promotions agrees that the winnings obtained and the promotions will be voided, including where there has been:

  • use of stolen cards;
  • creation of more than one account to benefit from promotions;
  • provision of deliberately incorrect registration data;
  • provision of forged or deliberately altered documents; or
  • any other fraudulent action intended to gain an edge over the Casino

9.4  The Casino reserves the right to apply restrictive measures where any of the above is detected in your account, including, without limitation, voiding any winnings obtained in breach and indefinitely barring access to the account.

9.5  The Casino will retain any payment where your account raises reasonable suspicion or where you have been involved in manipulating its systems. Criminal charges may be brought against any person who manipulates, or attempts to manipulate, the Casino’s systems. The Casino reserves the right to terminate or amend any game or event shown to have been externally manipulated, in order to restore play to its pre-breach state.

9.6  If you become aware of any error or flaw in the software, you agree not to take advantage of it and to report it to the Casino immediately. If you fail to do so, the Casino is entitled to full compensation for all costs arising from the error or flaw, including any costs linked to your failure to report it.

9.7  Funds deposited with the Casino are intended for entertainment purposes only. As an anti-money-laundering measure, each deposit is subject to a 1x wagering requirement — you must place bets equal to at least the deposit amount before the funds become available for withdrawal. The Casino will cancel any payment until the connected deposits have been sufficiently wagered.

9.8  The Casino reserves the right to close your Player Account and refund the balance, subject to deduction of any relevant withdrawal charges, at its absolute discretion and without any obligation to state a reason or give prior notice.

10. Refund Policy

10.1  A refund request will be considered only if it is made within the first twenty-four (24) hours of the transaction in question, or within thirty (30) calendar days where you allege that another person accessed your Player Account.

10.2  If you funded your account by credit card, the Casino reserves the right to pay all withdrawal requests, up to the total amount deposited, as refunds against the purchases you have made. Where your withdrawals exceed the total amount deposited, the excess will be paid to you through one of our alternative methods.

10.3  Before a refund is processed, any bonuses and winnings in your balance are deducted before the refundable amount is calculated.

10.4  Where credit-card purchases are considered to carry an unacceptable security or legal risk, whether by our payment processors or by the Casino, we will initiate refunds for those transactions back to the credit card and notify the relevant authorities and parties.

10.5  Any costs arising from the refund procedure are borne by the player.

10.6  To enquire about a refund, contact our support team at [email protected]. The documents usually required to proceed are (additional documents may be requested):

  • a photo of your ID;
  • a photo or screenshot from the payment system; and
  • a photo or screenshot of a document confirming your current address

We reserve the right to make a phone call to the number on your account, which, at our discretion, can form a necessary part of the KYC procedure; withdrawals may be suspended until the account is fully verified. We will make reasonable efforts to contact you about the withdrawal, but if we cannot reach you (by email or phone) within two (2) weeks of the date of your withdrawal request, the account will be locked, as the KYC procedure will not have been completed. Refund payouts are generally processed within five to seven (5–7) banking days.

11. Dormant Accounts

11.1  If you have not logged in or out for twelve (12) consecutive months, your account is given Inactive (dormant) status. While the account holds a positive balance, the Casino reserves the right to charge a monthly administrative fee of at least EUR 25 (or the equivalent in your account’s active-balance currency).

11.2  By accepting these Terms and Conditions, you authorise the Casino to debit this fee from your account at the start of the month following the day your account became Inactive, and you will be informed by email. The Casino will stop charging the fee once the account is reactivated or its balance reaches zero.

12. Complaints Procedure

12.1  The Casino provides a dedicated procedure for addressing complaints. You are encouraged to submit a complaint through customer support channels, including live chat, the support email address or an online form. You will be acknowledged no later than 24 hours after submitting a complaint, and once the investigation is complete you will be informed of the outcome and resolution by email. A follow-up may be carried out to gather feedback on the process and outcome. All complaints, investigations and resolutions are documented for record-keeping and quality-assurance purposes.

12.2  If you are not satisfied with the Casino’s resolution, you may escalate your complaint to the gambling authority or request a review by a designated gambling dispute-resolution service.

13. Expiry Period

13.1  You agree that any claim or cause of action arising out of or relating to these Terms and Conditions, or to a service provided by the Casino, must be brought within one (1) year of the date on which that claim or cause of action arose.

14. Non-Transferability

14.1  You may not assign, pledge or transfer, under any title whatsoever, any claims arising from these Terms and Conditions, from your use of the Website or from your participation in the games against the Casino, without the Casino’s consent. This non-transferability provision is made under article 83, paragraph 2 of Book 3 of the Civil Code of Curacao, and covers the transfer of any asset of value of any kind, including but not limited to ownership of accounts, winnings, deposits, bets, and any rights or claims connected with these assets, whether legal, commercial or otherwise. The prohibition also includes, but is not limited to, the encumbrance, pledging, assignment, usufruct, trading, brokering, hypothecation or gifting of such assets, whether in cooperation with a fiduciary or any other third party, company, natural or legal individual or entity, in any form whatsoever.

15. Arbitration

15.1  Any dispute that may arise between you and the Casino (including their successors in title, whether under general or special title) as a result of these Terms and Conditions, or of any further agreement or other act connected with them, will be settled exclusively by arbitration in Curacao, in accordance with Curacao Civil Procedure Rules.

16. Users Are Not Allowed

Among the other prohibitions set out in these Terms, you are not permitted to:

16.1  study the source code of the games, tournaments, lotteries or betting offered on this Website, make any corrections to it, or create derivative works based on it, unless the Casino has given written consent;

16.2  give third parties, including family members, access to any of the Website’s offers through their account;

16.3  use the services of the Website under another Player Account;

16.4  transfer your Player Account, or buy it from another user, exchange it, or receive it as a gift;

16.5  use another person’s contact details to send mailings (spam);

16.6  make deposits on behalf of third parties (in particular relatives, friends, spouses or partners);

16.7  use the games on the Website in any way that interferes with their normal operation;

16.8  use bots (programs that automatically perform actions on the Website through the ordinary user interface), cheats (codes that change a program’s algorithm to gain an advantage in games, tournaments or lotteries) or any other program that disrupts the normal functioning of the Website;

16.9  carry out fraudulent actions for your own advantage, including using stolen, cloned or otherwise illegally obtained credit- or debit-card data to deposit into your account;

16.10  engage in any criminal activity, including money laundering or any other activity with criminal consequences;

16.11  collude, or attempt or intend to collude, directly or indirectly, in any scheme with another user during any game you play on the Website;

16.12  act as a representative of the Company;

16.13  distribute copies of the games for any purpose, such as providing access or download links to particular individuals or to a wide audience;

16.14  translate any game into another language without the Company’s written consent;

16.15  publish advertising material, commercial offers or any other information on the Website, unless agreed with the Company in advance;

16.16  it is also forbidden to:

  • post information about the Website, or links to it, on other platforms;
  • use abusive language;
  • make threats of violence or bodily harm;
  • promote extremism or use nationalist or other such slogans;
  • direct offensive, threatening or otherwise inappropriate remarks at other users;
  • publish material containing elements of violence, cruelty or racial hatred;
  • use malicious programs or post links that may contain malware; or
  • publish any information the Casino considers inappropriate or objectionable

16.17  You are prohibited from using the services or software for any illegal or fraudulent activity or transaction (including money laundering) under the laws of your jurisdiction.

16.18  You are not allowed to use a Player Account to store (“stash”) money.
